Catherine Gertrude Bender was arraigned Monday afternoon for driving on a suspended license causing death in the Dec. 16 fatal crash in Hopkins Township, which kill John Jerome Dolegowksi.
The charge carries penalities of up to 15 years in prison and fines up to $10,000.
Allegan County Sheriff’s deputies arrested Bender after the crash, which happened near the intersection of 130th Avenue and 22nd Street.
The investigation indicates Bender did not stop her passenger car and struck Dolegowski’s truck with such force he was ejected from the vehicle. Dolegowski was not wearing a seatbelt; Bender was.
Bender, 45, was driving someone else’s car and that person, who has not been named by police, is expected to be arraigned on a charge of knowingly allowing a person with a suspended license to drive. That charge carries penalties of up to five years in prison and fines up to $5,000.
