WASHINGTON (WHTC) - David Patchak’s lawsuit aimed at closing the Gun Lake Casino in Bradley has a status hearing scheduled today at US District Court in Washington. The former Wayland Township trustee claims the gaming house has lowered his property’s value, as well as brought crime, pollution and diversion of municipal resources. He is seeking to overturn the Interior Department’s placing of the 147-acre tract off of 129th Avenue near US-131 in trust for the Gun Lake Band of Pottawatomi Indians, saying that the tribe was not recognized at the time when the law establishing such trusts was passed 80 years ago. The government and tribe contend that Patchak has no standing to sue and the Quiet Title Act bans such litigations. The casino opened more than three years ago.
