LANSING, MI (WHTC) - The state Court of Appeals yesterday reinstated a civil lawsuit filed by the family of Chance Nash against Grand Haven’s Duncan Park Commission. The 11-year-old Nunica boy died on New Year’s Eve of 2009 when his sled slammed into a downed tree at Duncan Memorial Park. The family contends that the commission failed to properly maintain the park by not moving the log; the commission countered that the deed to the land prohibited any altering to the park’s natural state. The litigation now returns to Ottawa County Circuit Court for legal proceedings.
