Testimony continues in same sex adoption trial

DETROIT (WKZO) -- There is no guarantee that surviving parents who are part of a gay or lesbian relationship would be awarded custody of their partner's children, according to federal court testimony.

University of Michigan Law Professor Vivek Sankaran was on the witness stand Wednesday as part of a trial over whether the state's amendment banning same sex marriage is constitutional.  April DeBoer of Hazel Park brought the case with Jayne Rowse and says the discussion about their children's future is at the heart of the case.

The Michigan Attorney General's Office argues guardianship would remain with a surviving partner and Sankaran on cross examination speculated that courts would want to abide by a decedent's wishes.
