KALAMAZOO, MI (WHTC) - An out-of-court settlement has been reached between six families living near the Birds Eye fruit plant in Fennville and the food producer over alleged water contamination of wells due to fertilizer sprayed on the plant’s fields off of Sherman Street. No details were disclosed in sealed documents that led to the dismissal of legal proceedings at US District Court in Kalamazoo 12 days before jury selection was to begin in the civil trial. Birds Eye had been doing the spraying under a permit by the state DNR at the time; the affected residents have since been connected to Fennville’s city water system without an installation fee. Other lawsuits have either been settled or have been dismissed; one that was discharged involving a separate group of litigants is being appealed. Noted activist Erin Brockovich had made an appearance in the area five years ago to support the litigants’ efforts.
