HOLLAND (WHTC) - The Michigan Court of Appeals has rejected a request by the Sierra Club to join the Michigan Department of Natural Resources and Environment in an effort to block expansion of the Holland Board of Public Works’ James DeYoung plant. In a 2-1 decision released Friday, the appellate court upheld a ruling by Ottawa County Circuit Judge Jon Van Allsburg blocking the Sierra Club and the Natural Resources Defense Council to intervene in the case as defendants, after the state reversed its initial decision against approving a permit for a 78-megawatt boiler for the plant. Justices Kathleen Jansen and David Sawyer say the environmental groups failed to show they had legal standing to intervene. Two other lawsuits against the utility and city over the planned expansion remain in the courts.
