LANSING, MI (WHTC) - Bob Genetski will indeed have to have his day in court.

The second-term state House Representative from Saugatuck was formally charged by the Ingham County Prosecutor’s Office yesterday with one misdemeanor count of drunken driving and one civil count of refusing a breathalyzer test. Genetski had been pulled over by a Michigan State University campus police officer after he had attended the State of the State address at the Capitol on January 19th.

Genetski was arrested and jailed briefly, but claims in a statement released the following day that “at no time did I feel that my driving ability was impaired,” and that he refused to take the breathalyzer test because “I felt that I had passed the field test.” The prosecutor’s office countered that results from a yet-undisclosed blood test proved otherwise. Genetski has refused further comment since his statement on the matter.

The misdemeanor count is punishable by up to 93 days in jail, 360 hours of community service, and a maximum 500-dollar fine upon conviction, while the civil count could lead to a one-year license suspension and six points on the driving record.

A pre-trial court hearing date wasn’t immediately disclosed.
