GRAND HAVEN, MI (WHTC) - Prosecutors wanted a first-degree conviction, but Ottawa County Circuit Court Judge Ed Post thought otherwise. In a bench trial that concluded yesterday, he found 23-year-old Justin McIntyre guilty of second-degree child abuse stemming from an August 24th incident in which his six-week-old son was “violently” shaken at the Spring Lake home of the boy’s mother’s parents. Bentley McIntyre couldn’t stop crying when his father returned home in the early morning hours from work, and his head struck a closed laptop when the man threw him down on the bed in an apparent fit of rage. The child suffered brain injuries in a subsequent shaking, and continues to suffer seizures while recovering from the incident at his home. Justin McIntyre remains jailed pending a January 28th sentencing, and could get up to 10 years in prison as a first-time offender.
