(Allegan, MI - WHTC News) - There apparently won't be a do-over in Saugatuck Township.
A lawsuit challenging the decision not to recount ballots from the May 4th election in which a half-mill tax increase was approved by a two-vote margin was thrown out on Thursday by Allegan County Circuit Court Judge Kevin Cronin. He ruled that the litigation, filed by two citizens, against the township and the county board of canvassers was without merit.
The lawsuit alleges that the township willfully tampered with the ballots after the election, making them unable to be recounted, and that the canvassers should have gone through with the recount anyway. The township countered that it was only complying with the county clerk's office in opening ballot cannisters for inspection, and that it was not intending to avoid a recount that may have been to its disadvantage.
It wasn't immediately known if Cronin's decision would be appealed to the state court of appeals. The Michigan Attorney General's office is investigating the matter to see if any criminal actions had occurred.
